The Affordable Healthcare Act – aka ObamaCare – reaches far beyond the enumerated powers granted Congress by the people. It stands because the Obama’s lawyers changed the argument from mandatory health insurance to taxation. Arguing solely before the Supreme Court in this way gave license to the majority ruling that, as a tax, this law falls within the enumerated powers of Congress to lay taxes. As a political strategy, Obama’s people were the victors.
As a tax law passed by Congress, it is a tax law that can be repealed by Congress.
Senator Ted Cruz and a handful of stalwart conservatives like Sen. Mike Lee, Rand Paul and Marco Rubio steadfastly call for defunding and repeal of this law.
Keep in mind this important fact: the IRS will administer the law and the IRS employees are presently lobbying to exempt themselves from it.
Since this president and his cabinet see themselves above the law, just repealing it will mean little because this corrupt administration will continue to force it down our throats.
